The defense attorney is trying to support his client's innocence with eight legal expert opinions and is asking the court to acquit his client, who was convicted of attempted murder and terrorist acts, 24.hu reports. According to the final decision, Gergely László Papp can be paroled from his sentence after thirty years at the earliest.

The crime took place on the evening of September 24, 2016, on Teréz körút. According to the final verdict, Gergely László Papp fatally wounded two policemen with a hell machine he made and put into operation in order to obtain their weapons. But when he saw that the policemen were alive, he left without the weapons. The two staff sergeants suffered permanent injuries, and their lives were saved only by quick medical help. It took them eight months of treatment and rehabilitation before they were able to work again.

According to the verdict, before the assassination, the perpetrator carried out test explosions with self-made bombs in the forest near his rural home and carefully studied the selected location, then added several kilograms of nails to the infernal machine that exploded on Teréz boulevard to enhance the effect. Shortly after the act, he wanted to get money by planning to demand one million euros from the Ministry of the Interior in order not to commit any more assassinations.

In March 2017, Gergely László Papp installed and then dismantled the camera monitoring him in his cell on Venyige Street. After that, he was taken to the Judicial Observation and Psychiatric Institute (IMEI), where he received haloperidol and rivotril injection therapy and medication for more than a month, and then tried to commit suicide. He was then treated with medication for several months. On December 13, 2017, Gergely László Papp was again admitted to the neuropsychiatric department of IMEI, where he again received haloperidol and rivotril injection therapy for eight days. Three days before Christmas, he was taken back to prison, where he was given rivotril and then discontinued.

The man's criminal trial began one month later, on January 31, 2018, at the Capital District Court. László Gergely Papp retracted his confession in the investigation department without any substantial justification at the first instance trial and behaved quite confused. He lay down on the dock because he felt tired, and when the guards tried to get him to see better, he threw himself on the ground. According to the attending paramedic, he intentionally displayed disorderly behavior. The man later did not even participate in the trials, so the first- and second-degree verdicts were announced in his absence.

In the newly submitted motion for retrial, the IT, chemist, physicist, engineer, and psychologist experts cast doubt on the claims and evidence of the final court verdict.

It is important that a retrial against a final judgment can only be used in certain cases, for example, if new evidence has emerged that the court did not judge. But this too can only give rise to a retrial if it could have resulted in a more favorable decision for the retrial party, if it were judged. There may also be a reason for retrial if the defendant lost the case based on a false expert opinion or false testimony. László Papp's lawyer, Gergely Papp, requested a retrial, referring to the newly discovered evidence and forensic experts' opinions. According to his point of view, expert opinions clearly support that it was not his client who blew up on Teréz körút in September 2016.

In this, one of the experts determined the perpetrator's height as 169 centimeters in the investigative department, and then changed this to 168-182 during the trial. Another expert identified a person shorter than 174-175 centimeters as the perpetrator after the first two measurements, and after the third he came to the conclusion that the perpetrator could have been at most two centimeters taller than 174.

The expert also identified a hooded figure behaving suspiciously, as well as a bald person in the camera footage of the nearby solarium, who were present at the scene, but were not identified or questioned during the criminal proceedings.

"In the previous stages of the accused's life, no circumstances or above-average aggressiveness or intent to kill could be demonstrated that would have encouraged him to commit an explosive act. There is no sign of intent to kill in his previous confessions either in the manner of the presentation or in its content," he claims.

The chemical expert who spoke in the submission pointed out that the bomb recipe given in Gergely László Papp's confession is not consistent with the material remains found at the scene of the explosion. According to the expert, the investigators found two receivers during the search of the man's home in Sandkomar. At the same time, according to the request for retrial, if the man had used two receivers during the test explosions and two at the time of the crime, there would not have been one left.

According to the forensic physical expert requested by the defense, the crime marks carrying the accused's DNA were arranged too regularly. According to his calculations, there is a 0.004 percent chance of the five sin marks scattering in such a straight line from the center of the explosion. That is, there is a 99.996 percent chance that the crime marks were not scattered like this spontaneously, but because of some external intervention.

The IT forensic expert analyzed the contents of the defendant's mobile devices, and according to his opinion, there were no traces of László Gergely Papp downloading or viewing pages related to the manufacture of explosives.

Dr. István Keviczki wrote in the submission that all these new evidences make it likely that the client should be acquitted of all crimes charged against him. Therefore, he asked the court to interrupt the execution of his client's sentence by ordering a new trial.

Gergely László Papp's father said he would do everything to prove his son's innocence. He said that they would disclose any "relevant, suppressed evidence" if they saw signs of "another biased process" or if they rejected their motion for a new trial. According to him, they filed a complaint with the Constitutional Court three years ago, but it has not been adjudicated since then.

"Although in democracies, guilt is supposed to be proven with real evidence, here they wanted to justify the incriminating facts with fictions and pressure.
